Conference "Modern regulation of intellectual property and licensing in the countries of the Eurasian Union"

Kistersky IP Law patent attorneys took part in the conference “Modern regulation of intellectual property and licensing in the countries of the Eurasian Union”.
The conference was attended by lawyers and patent attorneys of Belarus, the Russian Federation, Ukraine, Armenia, Bulgaria, Kazakhstan, Azerbaijan, Georgia, Finland, Poland, Moldova, Latvia, Germany and France.
The conference program included holding 8 sessions, during which issues of formation and development of the law of the EAEU in the field of intellectual property, a review of judicial practice on patent disputes, the practice of collision of industrial design rights and trademarks, new disputes in intellectual property were considered.
Session Topics:
- Intellectual property legislation in the countries of the Eurasian Union.
The questions of the formation and development of the law of the Eurasian Economic Union in the field of intellectual property, and development trends of the Eurasian patent law, issues of development of the legislation of the Republic of Belarus and the practice of the Federal Antimonopoly Service of the Russian Federation in the field of intellectual property.
- Pharma. Problems of law enforcement and legislative initiatives.
The issues of compulsory licensing based on the dependent patent, establishment of a single patents registry on drugs, as well as the review of the case law of patent disputes in the pharmaceutical field.
- Licensing: law and reality.
The issues concerning the practical aspects of service provision, performance and termination of licenses for intellectual property, commercialization strategies of industrial property using the example of scientific organizations and universities of Belarus, licensing in the IT companies.
- Patenting system. Violations and circumvention of patent rights.
The issues of determining the use of inventions, taking into account the doctrine of equivalents, practice of protection the rights of originators to pharmaceutical patents in the EAEC and CIS, perspective from Germany on the patent system in a number of countries of the EAPO.
- Geographical indications and appellations of the origin of goods: approaches to the protection of the EAEU and beyond.
The peculiarities of the protection of appellations of the origin of goods, geographical indications and traditional guaranteed goods in the EAEC countries were discussed.
- Trademarks, industrial designs, copyright objects: at the crossroads of the rights.
During the session the practice of collisions of rights of industrial designs and trademarks was reviewed.
- Franchising in the EAEC.
During the session the pecularities of the franchising agreements were reviewed and the practical examples of the use of franchising in the EAEC were introduced.
- New disputes in the intellectual property: violations on the Internet, blockchain, personal data.
During the session, new disputes in intellectual property were considered, namely, the blockchain and the trademark of the customs union, administrative and criminal legal mechanisms for the protection of software rights, personal data on the Internet, and the prevention of infringements of the exclusive rights to intellectual property protection using technical means of protection information.
During the conference, the organizers held friendly hosting, offered excursions to the Nesvizh Palace and the Mir Castle, during which all conference participants could communicate in an informal setting, find new business contacts and strengthen existing ties.
